Terms of Service
These Terms of Service (“Terms”) govern your use of the services provided by The Event Department LA (“Company,” “we,” “our,” or “us”), including all photobooth rental services, event activations, and related offerings (collectively, the “Services”). By booking, using, or accessing our Services, you (the “Client,” “you,” or “your”) agree to be bound by these Terms. If you do not agree with any part of these Terms, you should not book or use our Services.
1. Booking and Confirmation
1.1 Retainer & Deposit
A non‑refundable retainer (percentage or fixed amount as outlined in your booking summary) is required to secure your event date and time.
1.2 Confirmation
Your event date and Services are only confirmed once the required retainer has been received and we provide written confirmation. Until then, availability is subject to change.
1.3 Final Payment
The remaining balance must be paid according to the timeline outlined in your invoice or contract (typically a set number of days prior to your event). Failure to pay the balance on time may result in cancellation of Services and forfeiture of the retainer.
2. Services & Responsibilities
2.1 Service Description
We provide photobooth rental services as described in the selected package, which may include onsite attendants, equipment setup and teardown, props, custom print designs, backdrops, digital delivery, and other features listed in your booked package.
2.2 Setup & Access Requirements
You are responsible for providing:
Adequate space for booth setup and operation
Access to a standard power outlet (if required)
Safe, flat, and reasonable access for our team to deliver, set up, and break down the equipment
2.3 Booth Attendants
For Premium and Ultimate packages, professional attendants will be present in designated attire (e.g., black or white button‑down) throughout the Service Period to manage booth operation and assist guests.
3. Cancellation and Rescheduling
3.1 Cancellation by Client
Cancellations must be communicated in writing. Retainers are non‑refundable. Cancellations within a specified number of days before the event (as outlined in your contract) may be subject to additional charges or full payment obligations.
3.2 Rescheduling
Rescheduling requests are subject to availability. Payments made may be applied to a new date if confirmed in writing.
3.3 Cancellation by Company
We reserve the right to cancel Services due to unforeseen events, safety concerns, or breaches of these Terms. In such events, a full refund of all payments received may be issued at our discretion.
4. Event Conduct and Safety
4.1 Client Responsibilities
You agree to ensure that the event environment is safe for our staff and equipment. We reserve the right to cease Services without refund if conditions pose a threat to safety or violate venue rules, laws, or ordinances.
4.2 Guest Conduct
If guests behave inappropriately, violate laws, or endanger staff or equipment, we may end Services early. No refunds will be issued in such cases.
5. Use of Images and Media
5.1 Client & Guest Rights
All photos and media captured by guests during the event belong to the client and their guests for personal use.
5.2 Company Use for Marketing
We may request permission to use select media for promotional purposes across our website, social media, portfolios, or marketing materials. We will not use any images without explicit written consent.
6. Liability and Limitation of Liability
6.1 Equipment Use
The booth and equipment must be used only for their intended purpose. Misuse, negligence, or intentional damage by the client or guests may result in additional charges.
6.2 Limitation of Liability
To the fullest extent permitted by law, our liability for any claim arising out of or relating to these Terms or Services is limited to the total amounts paid by the Client to the Company. We are not liable for indirect, incidental, consequential, or special damages.
6.3 Force Majeure
We are not liable for delays or failures attributable to events beyond our control, including but not limited to power outages, weather, natural disasters, acts of government, or other unforeseeable circumstances.
7. Intellectual Property
All images, text, artwork, logos, and proprietary designs delivered by the Company remain our intellectual property unless otherwise agreed in writing. Clients have personal use rights for event media and deliverables only.
8. Payment Methods
We accept payment via approved methods listed on the booking agreement or invoice (e.g., credit card, bank transfer, online payment platforms). Credit card processing fees may apply.
9. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California. Any disputes shall be resolved in the state or federal courts located within Los Angeles County, California.
10. Changes to the Terms
We reserve the right to modify or update these Terms at any time. The updated Terms will be effective upon posting to our website. Continued use or booking after changes constitutes acceptance of the revised Terms.
